Alexander Law Group, LLP won a mediated settlement for $1,225,000 after a California resident was injured in a truck accident.

Not a typical Monday drive to work

On Monday morning November 5, 2018, San Francisco resident Ray Radpay, age 72, was en route to his business in Fremont.  His Toyota Corolla stalled to a stop on an uphill portion of the San Mateo Bridge. Although Ray warned traffic by turning on his hazard lights and waving traffic around him, his car was read-ended by a truck. The driver, Amrit Pal Singh, recently emigrated from Punjab, India, panicked as he attempted to brake and hit the gas. Ray’s Corolla was pushed a harrowing 442 feet uphill against the guardrail.

Ray, age 72, a successful aviation and auto mechanic, suffered injuries to his neck, shoulder and ribs.  The distress of his injury and the loss of an active life caused substantial emotional distress that impacted him and his family. Medical care was provided by Kaiser which claimed a lien of $45,732 for its services.

We filed suit

Suit was promptly filed on November 26, 2018, Alameda County Superior Court RG18929959.  Attorney Charles Roe, of the law firm of Samuelson, Wilson & Roe, San Jose, answered for the defendants who were insured with Progressive and Evanston.

Although the May 4, 2020, trial date was lost due to the virus pandemic, Ray’s lawsuit was fully prepared for trial with evaluations by Maureen Miner, MD, specialist in physical medicine and rehabilitation, and a life care plan by Dr. Diana Bubanja.  Peter Slabaugh, MD (orthopedics) and Peter Cassini, MD were hired to defend against plaintiff’s experts.

Settlement reached in Zoom mediation

With trial preparation concluded, it was agreed to proceed with a long-scheduled April 17, 2020, mediation with retired Superior Court Judge Jamie Jacobs-May with Judicial Arbitration and Mediation Services in San Jose, who skillfully conducted in all-day Zoom mediation that resulted in this settlement.
